R. v. A.J.P. [December 2010 - Alta. Q.B.] - Client was convicted at trial of operating a motor vehicle with a blood alcohol concentration exceeding the legal limit.  He successfully appealed and a new trial was ordered on grounds that he did not receive a fair trial.

R. v. P.M. [2010] (unreported, Alta. Q.B.) – Client was convicted at trial of operating a motor vehicle with a blood-alcohol level exceeding the legal limit.  Due to factual issues, the Crown conceded the appeal and the case was remitted for a new trial.

R. v. L.B. [2010] A.B.C.A. 90 (Alta C.A.) – Client was convicted of a convenience store robbery.  On appeal, a new trial was ordered due to identification issues.  Ultimately, the client successfully defended the case.

R. v. J.M.C. [2010] S.C.C. 31 (S.C.C.) - Client was convicted at trial of possession for the purpose of trafficking in approximately 5 ounces of cocaine.  The client initially unsuccessfully appealed to the Alberta Court of Appeal, but lost with a strong dissent.  The client then appealed as of right to the Supreme Court of Canada.  He lost a close 4-3 split decision.

R. v. J.F., [2007] A.J. No. 951 (Alta. Q.B.) – Client was convicted of impaired driving and appealed.   The case was returned for a new trial on grounds that the trial judge improperly used evidence obtained from the accused’s compelled direct participation in certain activities designed to permit the police officer to assess his level of sobriety.  Ultimately, the client successfully defended the case.
