First Degree Murder, Second Degree Murder, Manslaughter, Homicide Cases

R. v. D.H. [June 17th, 2011] - Client charged with second degree murder.  As a result of frailties in the Crown's case exposed at preliminary inquiry, the client accepted a plea to the lesser included offence of manslaughter.

R. v. A.V. [September 17th, 2010] - Client was charged with second degree murder along with a home invasion.  Notwithstanding advancing numerous Charter defences against the use of the Mr. Big Sting, he was convicted at trial.  Crown sought a period of 15-20 years parole ineligibility.   Client received 15 years.  The case is presently under appeal.

R. v. C.W.B., [2009] A.J. 696 (Alta. Q.B.) – Client was charged with first degree murder in a homicide involving a firearm.  The case was based primarily upon evidence obtained as part of a Mr. Big Operation wherein the client allegedly confessed to first degree murder.  After preliminary inquiry, the client plead guilty to manslaughter with a firearm and received a global sentence of 8 ½ years.  To read about the case, visit the Calgary Sun

R. v. D.C.A. [2007] (Unreported, Alberta Court of Queen’s Bench) – Client charged with ATTEMPTED MURDER.  After weeks of trial, the Justice acquitted the Client on the basis of frailties of eye-witness identification.  Cross-examination revealed numerous inconsistencies in the complainant’s version of events.

R. v. C.J.S. [2006] (Unreported, Alberta Court of Queen’s Bench) --Client charged with second degree murder for inflicting 56 injuries to the deceased with a meat cleaver.  After a month trial, the jury acquitted the client of second degree murder.
