Appeals

Occasionally an accused is convicted or improperly sentenced due to errors committed by judges, Crown counsel and even his/her defence lawyer. Though Canada’s criminal justice system operates on a presumption of innocence (and we all like to believe that truly innocent people are never punished for crimes they did not commit), occasionally wrongful convictions occur. In our legal climate, the reality is, successfully appealing a trial judge’s decision may be difficult. Due to our legal tradition of deference to the trial judge successfully appealing may be virtually impossible.

Successfully appealing requires experienced and creative counsel – a Calgary appeal lawyer who understands the complex machinations of the criminal justice system. Conducting an appeal requires both written and oral argument and may even require an application for bail pending appeal.
