Theft, Fraud, Possession of Stolen Property, Counterfeiting and other Property Offences

R. v. R.P. [January 7th, 2011] - Client charged with theft of a motor vehicle.  The case was successfully defended on the date of trial.

R. v. H.C. [October 8th, 2010] - Client was charged with a trust fraud.  After problems with the Crown's case were exposed on the first day of trial, a plea bargain was struck such that the client would receive no criminal record.

R. v. C.E. et al [March 2010] – Client was charged with break and enter with intent to commit robbery.  After 5 days of trial, the client was acquitted on grounds that the crown failed to prove the mens rea and actus reus of the offence.  Notwithstanding that the Crown sought convictions for lesser included offences, such as theft and possession of stolen property, the client was acquitted on grounds that the trial judge was left with a reasonable doubt.

R. v. P.A.L. [October 2008] (unreported) – Client charged with a home invasion robbery.  Charges stayed mid-trial due to extreme frailties in the identification evidence.

R. v. D.S. [2008] – Client charged with a sixty thousand dollar trust theft (theft from employer). Despite the Crown’s request for jail, the defence obtained a rare conditional sentence order.

R. v. V.M. [February 24th, 2009] – The accused was charged with a convenience store robbery.  The accused’s maintained the position that it was not a robbery, but a non-physical verbal assault.  At the conclusion of trial the accused was found not guilty of robbery.

R. v. R.S.E. [November 2008] (unreported) – Client charged with Break and Enter and mischief.  Client was acquitted after trial on the basis of frailties in the identification evidence.
